Nvidia kernel mode driver crash (GTX 670)

Hi there, new to this forum as I have literally been pulling my hair out trying to sort this problem.

My setup is as follows:
i5 4670k
Gigabyte Z87X SLI
Gigabyte GTX 670 Windforce OC Edition
Corsair RM750 PSU ( recently purchased)
8GB Corsair ballistix ram
120GB Kingston hyper x ssd
1TB Samsung F1 hdd
Basically my problem is that no matter what I seem to do, I get a Nvidia kernel mode driver crash. I've tried RMA'ing the card and they've told me it's fine. I even purchased a brand new power supply thinking it would help. I have updated the VBIOS on the card to the latest too. I've tried going into the control panel and changing the power mode to prefer maximum performance. Furmark will also not run as it returns error code 7 with a TDR. I have also swapped out my motherboard and cpu for my older i5 750 to see if that made a difference and it hasn't. I've freshly installed windows 7 to see if that makes a difference and it does not. Any help would be appreciated as I am running out of options. Thanks.

Have you tried the latest driver? (fix 353.38)
