I had a very similar issue here in Australia, except my retailer excepted my RMA for my motherboard and gave me the runaround with "Oh it's up to the distributer to fix it." So I rang the distributer and they said it was up to the place of purchase to either repair or replace it. So after a few months of getting duck shoved from one place to the other I threatened legal action and put in to my retailer a letter of demand to get the legal stuff started. So then the retailer gave me a replacement board which was not only used but a different version and an X38 instead of a X48. They told me that I had to except this as my board and tough s*** for me!!! I rang Gigabyte Australia and spoke to a very nice man who listened to my story and he told me that Gigabyte will NEVER give back a 2nd hand board if they can't repair yours, they will ALWAYS give you back a brand new board the same and revision you purchased, or if they can't, they will give you the next board up!! So keep that in mind. Anyway I think (pretty sure) that with the recall of ALL the P67 boards due to the intel fault with the SATA II controller, Gigabyte will take back all boards wether dead or not!!!!!!!!! Good luck hope this helps.
