Z77X-UP5 TH loses NIC on cold boot or sleep on Win 8

Not sure what is going on, but most times when waking from sleep or first cold boot I lose internet connection.  I can get it back by going to device managerm and scan for new devices.

I also notice it says I have a 82579LM chip when connection is lost, but when connection is restored it says I have an 82579V chip.

I tried the 17.2 drivers from Gigabyte's website then 17.3 from Intel's website and most recently 17.4 from Intel and they all do the same thing.

Any ideas what is going on?

ps, when I boot with no connection windows 8 sometimes reports I have an invalid copy of windows 8 and wants me to activate it.  I ignore it and go to device manager and scan for new hardware to get my connection back and then windows 8 says it is activated.

Occasionally when I cold boot or restart (usually after deactivation occurs), I get the initial windows 8 frsh install startup screen about setting up my pc for first time use.  All my programs seem to be unaffected, but not for sure about this.

I'm running Windows 8 64 bit on this board and am not encountering this issue.
What BIOS version are you running? I have the F12e and there is a BIOS setting in that for if you are running Windows 8 which I have set and that could be the reason.

I started with BIOS F9 then upgraded to F11 and finally I upgraded to F12e about a week ago.

Could you share this unusual win 8 compatibility setting in the BIOS?

Can you search for Intel 82579v driver for UP5.

Thank you for your reply ex58.  The driver package has both (and all Intel NIC drivers) already preinstalled.  It finds the v version just fine, it just misconfigures it when waking from sleep or cold boot.

although, I did find this weird, "NVM Update Utility for Intel® 82579V Gigabit Ethernet PHY Network Connection" that claims to fix the problem I'm having:

This utility resolves an issue where during system resume, the Intel® 82579V Gigabit Ethernet PHY Network Connection erroneously reports the device id as an Intel® 82579LM Gigabit Ethernet Controller Network Connection, resulting in a Windows* Code 10 error and loss of network connection.

It seems to work so far, but only test a few times.

You can find this setting under the Integrated Peripheral section of BIOS under the heading OS Type. I have set it to Windows 8 on my system although I am still not sure what it is for or what, if any, improvements it has made.

I think I found the issue.  My BIOS has Network Stack for UEFI set to disabled.  I sedt it to enabled and no more issues.  It's only been a couple of hours, but so far so good.

Well, it started giving me NIC issues again.  This time it was only warnings about not having internet access although it was always online.  But it woukd ding every-so-often while playing Company of Heroes online.  Plus event viewer showed it not being able to check for updates periodically.

I decided to disable my on-board NIC and install my Intel CT Gigabit Ethernet adapter EXPI9301CTBLK and now windows has deactivated itself?  Is M$ trying to force users to buy new windows every time you do a minor hardware upgrades like they tried to do a few years back?
