3.8.0-23-generic #34-Ubuntu SMP
and custom 3.9.5 kernel

I read that it's Bios related, might be wrong

Also there have been a few bugs of settings not being saved properly when switching between uefi only and uefi+legacy, but that's not related to this.

Not really.

The BIOS needs fixing and an update.

When dual booting Win8 and various Linux dists the BIOS resets itself which leads to an unbootable system.
Pressing the power button shortly on a running system suspends the PC but there is no way to wake it up, so you have to press 4  seconds to power off, then again the BIOS resets.

When can a newer version be expected? Is there still work being done regarding the BIOS?

When I write reset I mean, memory settings are set to normal, as are CPU settings and fans. Boot modes are set to uefi and legacy, Virtualization is turned off, xhci is set to smart auto, sometimes SATA ports are turned off, sometimes they aren't, audo is enabled, Marvel SATA controller is set to auto. It's a mess.
It's probably applying fail-safe defaults, but why?
