How to guarantee a NEW (not refurb) board for RMA?

... about problems I was having with a GA-Z87X-UD4H board.  I have had many back and forth messages with Gigabyte Support, and they told me that my problem sounded like a faulty board, and I should RMA it.  NewEgg wouldn't take it back due to one of the DIMM retention clips having broken off when I opened it (I used normal force, so it was a board fault).

I asked Gigabyte Support if I can be guaranteed a NEW board (not refurb) and with a C2 chipset (to avoid the USB 3.0 issues I was having).

Gigabyte Support replied back that they would "attempt to repair" the board and if they had to replace it, send me one "of equal condition" and would give me one with a C2 chipset if they "determine that the C1 chipset is at fault".

That's not what I asked them, so I asked them again if they could GUARANTEE me what I was asking for, and that I wouldn't be satisfied unless they did.  Still waiting for a response on that one.

Does anyone know how you can get a NEW replacement instead of a refurb?

And also, we all know about the chipset revision problems - how could Gigabyte possibly think they could "repair" a board that needs a new chipset revision? It's likely I was talking with multiple people on the Gigabyte Support site, so is there any way you can speak with a human being in some upper-level support capacity who is technically competent and understands the problems?

Remember, when all else fails a cup of tea and a good swear will often help! It won't solve the problem but it will make you feel better.

Thanks much!  The Gigabyte Support person on their website gave me the US contact number as well, and that was going to be my next step.
