GTX 970 Mini ITX RMA'd Came back still crashing PC on gameplay

Setup:
EVGA z97 Stinger
i7 4790
16gb Corsair V. Ram
Noctua NH-U9B SE2 Cooler
GTX 970 Mini Gigabyte
Case/PSU: EVGA Hadron Air/500W Gold +

Ok so the main thing is that when I start the PC everything is normal, I believe there is something interfering with the connection first off. When I first purchased the card in the spring, it worked fine on Dark Souls. Then I tried booting up Witcher 3 and it crashed after start cutscene. I somehow got the card to work after re-seating it multiple times but I had to adjust something in the PC and it wouldn't work again. I RMA'd the card and it came back with no repairs needed :(

I was able to get some benchmarks working but the cards seems to be able to move slightly back and forth until I screw it in. I am absolutely sure it is the cards issue though because my gtx 660ti works fine. I also tried the 970 in my old system and it crashed that system as well.

I am just curious if anyone is having similar issues or if anyone can help me figure out what I can do to get this card working. I can post some pictures if needed.
