Gigabyte GV-N970WF3OC-4GD GTX 970 runs Fallout 4 only at 114 Mhz / 253Mhz ?

Yesterday i bought Star Wars Battlefront and the game starts, but became black screen , freezes and display kernel error message.
Btw. the same error with Fallout 4 !
Windows 10 Pro 64 bit.
Display Driver stopped responding and has recovered...
Tried different drivers...always same error.
Same s*** on Windows 7 Ultimate 64 bit.
Mainboard Bios is up to date and on setup defaults.
Card Bios is up to date, Bios F11
Nothing is overclocked here, all default settings.

Far Cry 4, WOT, Armored Warfare, no problems here, can play without any errors.

My Specs are:

Gigabyte Z87X-udh4
Gigabyte GV-N970WF3OC-4GD GTX 970
16GB Crucial Ballistix Sport XT DDR3-1600 (2x 8 GB)
Intel 4790k CPU
Samsung 840 Pro SSD
BeQuiet BQT L8-CM-630W
Windows 10 Pro 64 Bit (tested with Windows7 Ultimate 64 bit, same problems)
Newest nvidia driver 359.00 installed
Samsung SA300 and LG W2240 monitors

Got my money back from ea-sports cause i can't play Battlefront with my gtx 970 (bought January 2015)

So today i tried something:

When i underclock (OC Guru II) the GPU and Memory Clock with -1000 Mhz ! , Fallout 4 starts and i can play...

So, the card runs stable with Fallout 4 at Base 114 mhz / 253 Boost and 6008Mhz Memory clock... :o

Is my graphic card defect ?

I played Fallout 4 now for 1 hour without any crashes, with this settings:
