GTX 560 Ti SO 950 - 90C in games, 100C in tests

Hi, as you can see in my topic name : 89-90C in Bf3 medium settings, 100C in kombustor, it would go higher but I stopped it. it's a rev2.0 560ti.

It was a hot card from the beginning, 56-60 C iddle. The company I bought the card from said it was okay etc etc, which is not okay at all and they won't let me reapply thermal paste, nor will they do it. They would rather wait until I RMA it...

I saw in MSI Afterburner how the card is down throttling 350-450 hz almost every second when it's over 70c, which is, all the time in a game. Black screens in BF3 every session, I got sick of it.

 I wanted to downvolt the card which is volted @ 1112 from the factory but it won't change nor would the gpu/shader/mem clocks.

 EVGA precision of Afterburner set the card to lowest, like 450 hz, but in reality the card is still 950 Hz checked with gpu-z.

My card is GV-N560SO-1GI-950.F11. I found a F13 bios on the net, but nvflash said it's not compatible, it probably it is for the rev1 card.

Is there a newer bios or something I can do before i meddle with nibitor and maybe(surely) brick the card?

My sys :  I5 2500K - Asrock P67 Pro3 -Psu Antec 750W- 2x4 Gb Corsair Vengeance @1600-Cooler master HAF 922 case all fans attached and working at maximum, win7-64, gaming @ 1680x1050
