GA-MA770T-UD3P and RAM stablility problem -> need guidance

I purchased the Mushkin memory knowing it wasn't on the certified RAM listing for the motherboard.  I thought that by playing with the Memory Clock, Timings, Dram Voltage, and CPU NB VID control I could make it stable and working at DDR1333 w/ 7-7-7-20.

Using different Dram Voltage and CPU NB VID control settings I cannot get the box stable at the DDR1333 7-7-7-20 settings (freezes and resets).  I've tried all the different combinations.  The only way I can get things stable is to run the RAM at 533mhz with the 7-7-7-20 with the default Dram Voltage and CPU NV Vid control. 

I submitted a support request with Gigabyte with my issues but and I got this response:

"1066 is the default spec on the memory controller, any spec above 1066 would be overclocking and we are unable to guarantee any results off from overclocking."

Is this correct???

Is anything above 1066 overclocking on this motherboard? 

The  website says:

"Dual Channel DDR3 1666+ MHz Delivering native support for DDR3 memory up to 1666MHz"

I'm ok with purchasing certified DDR1333 modules but am hesitant if anything above 1066 is overclocking for this motherboard.

Is this a rtfm?  What am I missing in all of this?

The memory is the problem,
The memory controller is in the CPU I believe,

Hi,
Pulled this from the AMD website,
The Phenom II only supports 1333MHz DDR3—at least, officially—with a single DIMM in each memory channel. With four DDR3 DIMMs, 1066MHz is the standard. Such limitations are nothing new,

Have you ran memtest on your ram? It might be bad ram.

When I got some corsair ram for my last build it wouldn't run at the rated settings. I ran memtest and guess what? It failed. Luckily Fry's was cool about taking it back.

Hello.
I won't make new topic because i have same problem here with my Patriot PGS Gamer Edition 2x2048 1600 CL7 LLK memory.
I can only run this memory in 1333mhz CL7 even with standard 1.6-1.8V but I would like to use it original mem -> 1600Mhz
 I know that after a huge OC of this motherboard i have a chance to run that memory on 1600mhz.
But it is also unknown how long can it works on 1600mhz without any BSOD.\
(Motherboard rev is 1.0)

Is there any solution for that?
