GV-R697OC-2GD. Faulty card or Driver issue?

Hi all,
I've just built a new rig and am having a few issues with my new HD6970. (GV-R697OC-2GD)
I have no problems in windows etc or playing most newer games with high graphic settings. i.e Bad Company 2, Battlefield 3, Deus Ex, Crysis 2, Diablo 3 beta all work perfectly.

The problem seems to be when I try to play any non dx10/11 game.
The games listed below all show flickering artifacts when AA is enabled so I have to disable it.
Oblivion - I can't even get out of the first room without a hard lock up requiring a system reset.
Skyrim - This will either hard lock my system or drop to windows with the message "display driver has stopped working and recovered", usually within 30 seconds/1 minute of playing. Also, whenever I press M to bring up the map, it will instantly crash.
WoW- This works as long as I disable AA. Turning on AA causes artifacts but still plays.
Torchlight - same as WoW.

The card is installed as is. No bios update or OC other than the factory OC.

I've also removed the card and re-installed my old 5870 from my other PC for testing.
With that installed, all the games listed above work with no problems what so ever.
Installing the new 6970 in my old machine causes the same issues as listed above.

So... what do you guys think?
Should I return the card for a replacement due to a faulty card or is this possibly a driver issue.
I'm really not happy about paying 400 odd dollars for a new card and not being able to play games that I could before :(

Motherboard: Gigabyte Z68X-UD3R-B3
CPU: Intel i5 2500K non overclocked.
PSU: Corsair HX850
Ram: 16GB G.Skill 1600Mhz
Drives: Corsair M4 SSD, WD Caviar Black 1T x2

I'm running Win7 64bit Ultimate and I'm using 11.11 Catalyst. (note: had the same problems with 11.10)

Hi and welcome.

It would all certainly seem to point to a faulty graphics card, possibly the memory on it but whatever I think the best course of action is to replace it. It is always possible that playing around with the voltage and timings might help but as it's a new card I wouldn't want to start by messing with it personally.
